Northern Beaches Council received an offer to enter into a planning agreement for the land at 321 to 331 Condamine Street, Manly Vale. The agreement is required as a condition of the development consent.

The development application was approved on 11 February, 2022 to knock down existing structures and construct a four-storey shop-top housing development. There will be four retail tenancies on the ground floor, 26 residential apartments over three levels and a basement carpark for 43 vehicles.

The consent also requires the developer to reconstruct and widen Somerville Place to provide a six metre wide road reserve adjacent to the site.

A planning agreement is the legal mechanism required to facilitate the dedication of land containing the widened road to council.

The draft planning agreement will offer benefits, at no cost to council including a dedication of 54m2 of land to council for the widening of Somerville Place. This will occur after the developer has constructed the widened road. In addition, there will be an easement for public access over a privately owned footpath adjacent to Somerville Place.
